Landfill Debate Challenge

The election may be over, but the fight between the Landfill Taskforce and the Simi Valley Landfill continues to rage on. The Taskforce recently submitted a letter to the General Manager of Waste Management’s Simi Valley Landfill to debate the issue of the expansion in a public forum. The letter reads as follows:

The Simi Valley Landfill Expansion Taskforce invites Waste Management to participate in an open forum/debate on the issues surrounding the expansion of Simi Valley Landfill. We believe the community would benefit from an opportunity to hear all sides of the proposed expansion in a forum that ensures the debate does not become a battle of competing sound bites, half-truths and unanswered questions.

A community forum/debate with mutually agreed upon rules would prove beyond a doubt WM’s commitment to the principles outlined in your April ll, 2007 press release announcing Waste Management’s application for expansion of the Simi Valley Landfill and Recycling Center. You stressed that WM is “committed to meeting the long-term waste disposal and recycling needs of Ventura County in an environmentally sensitive, cost-effective and community-focused manner.”

We would like to schedule this for early to mid December and have already spoken with California Lutheran University Professor Herbert Gooch, PhD. and he has agreed to serve as the moderator. I am hopeful you will accept our invitation at which time we can finalize the remaining pertinent details.

So far, all we know at this point is that Waste Management is in receipt of this letter. No official word yet on whether or not they will accept the challenge and participate in the debate.

    Ken, you may want to stick to your day job. Any party may make one challange to the assigned judge for any reason, or no reason. I would suggest that the high powered Sacramento hit team assembled by your handlers didn’t want the assigned judge because he knew too much about the applicable area of envirnomental law. Can’t have that when your goal is dirty deeds done dirt cheap.

    Soon Ken, soon, you will see that your beloved intended all along to tell the City where to shove it. Think dark alley mugging with your buddies swinging the two by four.

    I hope you are being well paid for your services.

    A little professional advise; Unless one has a long standing relationship, whores, like attorneys, should get their money up front for their services.

  2. Right on Mitch, as always. Waste Mgt. used the one challenge they had that doesn’t require cause. Truth be known that the Judge was extremely knowledgeable in this field and recognized as the best judge of 2010 by the County Bar Association. Waste didn’t want this judge for reasons, but those reasons didn’t have to be shared with the public.

  3. Mitch, you should be ashamed of yourself. I expected more from you, but I guess I should not be surprised, especially since you are a lawyer. I have no “handlers”, so that statement is an outright lie and you should know better than to make statements which you can not back up and which you know perfectly well are false.

    I took no campaign donations and don’t owe anyone anything. Perhaps you are just bitter because you spent a lot of money and did not do so well or perhaps because you can not do what you wanted to do to Sedell.

    I am not paid by anyone. I can not be bought, unlike attorneys and politicians. So your “professional” advice is worthless and is actually just a personal attack. It seems like you like to trash others, but not answer questions. Do you really want to be know for your lies? As they say, anything you say can and will be used against you.

    WM is not my “buddies”, so again you lie. It seems like a trend with you, but I guess that is to be expected from most lawyers. The truth does not matter, words are just a means to a goal. It is clear who your buddies are and you had best think about who they are and what they want.

    Please explain why, after all this time, that the task force, aka Barbra who is representing herself as City Council when in reality she is not representing the city.

    Yes, and the reasons behind the task force are not being shared with the public either. The system allows for WM to do what they did. I don’t know the reasons and neither do you, but it does make for a good baseless attack.

    The bottom line is that WM did nothing wrong, but that does not stop some people from attacking. Most likely Mitch has done the same thing, but that is different for some unknown reasons.

    Ask why the task force refuses to come out in the open and put up a web site with their position. Why do they have their “5 points” if they are just completely against the expansion? The real question to ask is what the motives behind their actions really are.

    I trust something is wrong with the above statement. I presume you are referring to Waste Management in “to make the (task force) agree to it”. If you do mean the Task Force as written, rest assured that I have been, and remain so today, ready to get behind the landfill expansion immediately upon learning that it is following all laws in its application process and it has addressed all negative impacts on Simi Valley to the satifaction of a majority of the City Councilmembers. To be clear, immediately upon learning that the City Council has successfully negotiated an agreement with Waste Management in which the City is made whole, I will see this as a win-win and will get behind the landfill expansion project without delay. I further believe that the entire Task Force, including Councilmember Williamson, will join me in this position. Unfortunately, it is my current opinion that Waste Management doesn’t tell the truth, doesn’t negotiate in good faith, and continues to attempt to mislead the public as to the specifics of the expansion project. I hope I am wrong and look forward to learning that the leopard has new spots.

  5. Ken, I’m shocked. I suggest that anyone who chooses to whore themselves should at least have the self respect to demand and payment.

    And me bitter over the election? Not since I shook off the hangover the next day. Beyond that, I had the money to spend and that was my choice. Creating the ad campaign and working with the graphic artists was good fun. I received name recognition, which is invaluable for a local attorney. If I want, I can now call on any council member and they will take my call. What’s that worth? And at last count, I received 4284 votes, which is not bad at all. Overall, I’m pretty happy with the results.

    But enough about me for now. At least, that’s the message I received from the voters. Perhaps you didn’t get the memo.

  6. Mitch, you certainly have shown your character, of lack thereof. It is quite clear what you are suggesting and it is completely false and basically amounts to defamation of character. It is also sexist and no doubt there are many people who are offended by your comments.

    Yes, I can see, based on your statements, that you can be bought and paid for quite easily, as you suggest. You don’t get doing the right thing for the right reasons.

    It is quite sad that you have to turn to alcohol and felt the need to get drunk after the election. To me, that indicates some serious problems and shows that you are most certainly not qualified to be on the Council (not that those who are on the Council are really qualified).

    I am not sure that the name recognition is a positive thing in your case. Your comments here certainly do not paint you in a positive light.

    I have to wonder why you think that just by running you think that you can call on any Council member and that they will take your call. If that it true, it certainly shows there is a serious problem with the Council since they should take to call from anyone in the public, but now you think that you are something special because you ran.

    As to the judge, did the task force in some way, shape or form select the judge? It seems clear that the task force wanted that specific judge and based on the messages it seems like it was not a random selection. If it was not a random selection, then it is clear that WM did the right thing, just as the task force would do if WM picked a specific judge.

    My comment is regarding to the 5 points that the task force demanded of WM, which was said was agreed to. Barbra refuses to say that if those 5 points were agreed to, would the task force support the expansion. The lack of an answer is telling.

    Personally, I have the opposite view, based on the lack of a web page from the task force, the deceptive comments made by various task force members, as well as the misrepresentation by a Council member (claiming to speak as a Council member when in reality it is a personal action). The comments regarding the traffic is also quite clearly deceptive.

    Apparently you have no concept of the terms “sarcasm,” “wit” or “self depreciating humor.”

    I can’t imagine you being any fun at a party.

    While I’m not a doctor, I did serve as an Army Medic in the Seventies, back in the day when the U.S. Army was considered the highest point in Europe. My observations: some people just need a strong dose of California legal herbalistic sedatives.

    Perhaps if you rolled yourself a big fattie and took the introspective time to see yourself as others do, you might be able to scrounge up enough couch change to buy a clue.

  8. I do have a concept of sarcasm, wit and humor. Perhaps if you used such things then it would be a different story. You resorting to personal attacks is just showing who you are. I know it started when I asked you questions which you refused to answer, most likely because it would show where you were really coming from.

    Yeah, I can see why you use drugs, including alcohol, in order to deal with things. Suggesting using drugs is just plain stupid, that is not sarcasm, wit or humor. It is just a baseless personal attack in order to try to make yourself feel better about yourself.

    You are not a medic and based on your statements I have not wonder how good of an attorney you are. Care to explain why you no longer work for the City? Was it because of your performance (or lack thereof)? Or was it due to personal issue and not getting along with others?

    Yep, one of the gang members. Same tactics and a refusal to answer questions or address issues, as well as personal attacks.

    It is interesting that the poor task force does not feel that anyone, other than themselves, can do anything right or follow the law.

    They do not trust Ventura County to do the right thing. They only trust one judge to get what they want and don’t trust any of the other judges. Clearly only one of the Council members is doing the right thing, although she is violating the Council Code of Conduct in multiple ways, says that developers have to give her money in order to get a fair hearing, etc.

    They are good at getting some people to join their cult and sing their praises.

    Mitch, did you EVER actually take a tour of the Simi Valley landfill? A question that you have previously refused to answer.

    Mitch, can’t you refrain from personal attacks?

    Everyone does not suck, but there are those in power who have either forgotten what they are there for or never knew. Council should be for people who want to serve the community, not themselves.

    Sanity is also defined by the society. A vegetarian in a tribe of cannibals would be considered insane.

  19. Perhaps you should study the law Mitch, oh, yeah, you claimed to have done that, so perhaps you need to go back again.

    More baseless attacks from Mitch. It does lead me to wonder about something about Mitch though. His words are interesting and the tone seems to be familiar, but who could that be? Perhaps I was wrong in thinking about who it was. There seems to be two types of people on this site, those who are interested in discussing the issues and those who just want to attack people. Those that are interested in discussing the issues are good, even if I don’t agree with them.

    Mitch also lies when he says my platform was “I don’t like anyone, everybody sucks but me!”. Flat out false statement. What issues did I have with Mike Judge or Keith Mashburn? Oh, that does not fit with Mitch’s attacks, so that has to be ignored. Yes, I have an issue with incumbents who are deceptive, as well as non-incumbents. Yes, there are issues with those currently on the Council, but Mitch ignores all that because he is now happy that because he ran he can call any of the incumbents and they will take his call. Clearly, he wants to be part of the in-group. At least he admitted that.

    So Mitch, care to talk about the City being Business friendly? Oh, yeah, you got a business permit and didn’t have a problem, so there is no problem. I guess the businesses who have had problems are wrong. I guess the City is wrong because they hired a business advocate and there are no problems. The problem, if Mitch had been paying attention, seems to be in regards to any building permits, not the simple business licenses.

  23. Ever since Camarillo State Hospital was closed, many of those most in need were put on the streets to live in society without the medical care that they required. Fortunately, the County recently opened the new Behavioral Health Medical Center behind Larwin Square. That is just east of 1st St. & LA Ave.

    Not Force, why won’t you answer as to whether you took a tour of the Simi Valley landfill? It seems that you are not willing to lie about certain things, but are more than willing to make up other things in order to attack people.

  25. Of course I went on the “tour”. It was PR spin and Waste Mgt. didn’t tell the truth about quite a few operational parameters. What in the world the “tour” can show about the expansion is beyond my imagination. It is a dump, a nice dump, a well run dump, for the most part operating within the law.
